General terms & condonditions.

1. Purchase of a balloon flight ticket

 

1.1 Customers can order a voucher from the operator online, by email, by telephone or by personal contact
 

1.2 The operator confirms the purchase by sending the following to the customer at the (email) address provided by him:

  • a voucher with a unique serial number,

  • a confirmation of the reservation,

  • additional information on the operation

  • the voucher can only be downloaded once 

  • the voucher is not refundable

  • The gift cards / vouchers can only be used on the special website of the seller.

 

1.3 When ordering, it is possible to directly book a balloon flight on a specific date (see article 2) or request a voucher.
 

1.4 The vouchers are transferable to other persons.

 


2. Booking a balloon flight


2.1 With a voucher the customer can book a balloon flight with the operator.
 

2.2 The operator confirms the reservation.

 

2.3 If the customer cancels within 48 hours before the start of the reserved flight, it is no longer possible to take this balloon flight.  The ticket(s) are, however, transferable, which means that in that case the customer can hand over his ticket to another person to take his/her place.

 

2.4 The voucher can only be used to book a date if it has been fully paid. 

 

2.5 The operator may cancel the balloon flight if the (weather) conditions do not allow for a guaranteed safe balloon flight. This is at the sole discretion of the balloon pilot.  In that case, no compensation or refund will be granted. Subsequently, the customer will book a new date for a balloon flight.

 

2.6 The voucher expires 2 years after being issued. The date of issue is indicated on the voucher. After this period no more reservations or balloon flights can be made with the voucher. An expired voucher does not entitle to any kind of compensation.

 

2.7  Unless explicitly agreed otherwise, the balloon flight will depart from one of the operator's fixed pick-up points. 

 

 

3. Execution of the balloon flight

3.1 The operator will carry out the balloon flight carefully, professionally and in compliance with applicable laws and regulations.

 

3.2 As ballooning is highly dependent on weather conditions, it is possible that the balloon flight experience might differ from the expectations. Any statement regarding the length and nature of the balloon flight is always based on an estimate and on ideal conditions.

 

3.3 The operator can cancel a balloon flight at the very last moment if the (weather) conditions do not allow for a guaranteed safe balloon flight. This decision is at the sole discretion of the balloonist. See art. 2.5.

 

3.4 The right to make a balloon flight with the voucher lapses in the following cases :

a. If the customer does not show up at the specified location and time, or does not show up on time.

b. If the client doesn't present a valid voucher and reservation form before the start of the balloon flight.

c. If, according to the operator's administration, no payment for the voucher has been received and the customer is unable to provide convincing proof of payment at that time.

d. If the customer is in a condition that poses a possible danger to himself/herself, the pilot, the team members or the fellow passengers (e.g. intoxication, unsuitable medical condition, pregnancy).

In all these cases, the balloon flight is regarded as having been carried out. Consequently, the voucher loses its validity.

 

3.5 The participants in the balloon flight have to comply with the instructions given by the pilot and other employees of the operator. This applies before, during and after the balloon flight.

 

3.6 The liability of the operator is included in the insurance file which is in accordance with the strict European regulations.

 

3.7 The liability of the operator is in all cases limited to the amount covered by the operator's liability insurance in the respective case.

 

3.8 You may not fly as a passenger if you:

  • have been scuba diving within the last 24 hours.

  • are pregnant.
     

4. Payment

​

4.1 Payment of the invoice for a voucher is also due if no balloon flight has not taken place (yet).

 

4.2 Payments to the operator have to be made within 10 days after the invoice date and in any case at least 2 working days before the balloon flight.

 

4.3 If payments are not made in time, the customer shall owe an interest of 2% per month on the invoice amount from the due date of the invoice.  At the first reminder € 25,- administration costs will be charged. In case of total or partial non-payment of the debt on the due date in the absence of any major justification, and after an unsuccessful formal notice, the debt balance will be increased by 12% with a minimum of €50 and a maximum of €1500, even if terms of respite are granted. If the operator has handed over the collection of the claim, the customer shall owe all collection costs incurred, with a minimum of € 125.

 

4.4 Payments shall always first be deducted from the costs and interest owed.

5. Complaints and disputes

​

5.1 Customers who are not satisfied with the execution of the agreement may submit a written complaint to the operator. The operator will, after having heard the customer if necessary, answer this complaint carefully and in writing.

 

5.2 Submitting a complaint does not entitle the customer to suspend any (payment) obligations.

 

5.3 Complaints must be submitted as promptly as possible, under penalty of forfeiture of rights, but in any case within 10 days of the incident that is the subject of the complaint.

 

5.4 This agreement is exclusively governed by Belgian legislation. Only the court in the district where the operator is located has jurisdiction.
